TERMS AND CONDITIONS FOR TENANTS – mediumterm.ch
1. Introduction
These Terms and Conditions (“Terms”) govern your access to and use of the mediumterm.ch platform (the “Platform”) as a tenant (“you” or “Tenant”).
The Platform is operated by Novagen SA, Via Cantonale 11, c/o Studio Commercialista Francesco Ippolito, 6900 Lugano, Switzerland, under Swiss law.
By creating an account, browsing listings, submitting inquiries, or booking a property through the Platform, you confirm that you have read, understood, and agree to be legally bound by these Terms.
mediumterm.ch acts exclusively as a neutral listing and communication platform and is not a party to any rental agreement.
2. Eligibility
To use the Platform as a Tenant, you must:
- Be at least 18 years old and legally capable of entering into binding agreements;
- Provide accurate, complete, and verifiable personal and contact information;
- Not use false identities, forged documents, or impersonate any third party;
- Comply with all applicable laws, house rules, and residency or immigration requirements during your stay.
You are solely responsible for ensuring that your stay complies with all legal requirements applicable to you.
3. Nature of the Platform
mediumterm.ch:
- Is not a real estate broker, agent, or property manager;
- Does not own, operate, or control any listed property;
- Does not verify, inspect, or guarantee properties or Hosts unless explicitly stated (e.g. “Blue Badge” listings);
- Does not guarantee availability, habitability, legality, safety, or suitability of any property.
Any rental agreement is concluded solely and directly between you and the Host.
Nothing in these Terms shall be construed as creating any partnership, employment, agency, fiduciary, or joint venture relationship between mediumterm.ch and any User.
4. Booking and Payment
Booking and payment procedures depend on the listing type.
a) Blue Badge Listings
For properties marked with the “Blue Badge”, all bookings and payments must be completed exclusively through the Platform using the designated third-party payment provider.
Reservations are confirmed only after:
- Successful payment by the Tenant; and
- Explicit confirmation by the Host, where applicable.
Off-platform booking or payment arrangements for Blue Badge listings are strictly prohibited and may result in account suspension or termination.
b) Non-Blue Badge Listings
For properties not marked with the “Blue Badge”:
- mediumterm.ch acts solely as a listing and communication platform;
- Booking terms, payments, deposits, and contractual arrangements are agreed directly between Tenant and Host;
- mediumterm.ch does not process, collect, hold, or monitor any payments or deposits;
- mediumterm.ch is not involved in the negotiation, execution, or enforcement of any rental agreement.
Any off-platform payment or booking arrangement for non-Blue Badge listings is made entirely at the parties’ own risk.
c) General Payment Disclaimer
mediumterm.ch:
- Does not act as an escrow agent or payment intermediary unless explicitly stated;
- Is not responsible for payment delays, defaults, currency exchange differences, banking fees, or disputes between Users;
- Does not verify or guarantee fulfillment of payment obligations between Tenant and Host.
5. Cancellations and Refunds
Each listing specifies its applicable cancellation policy, which you must review and accept prior to booking.
If you cancel a confirmed booking:
- Any refund will be governed strictly by the applicable cancellation policy;
- Platform service fees may be non-refundable.
If a Host cancels a confirmed booking, mediumterm.ch may facilitate a refund in accordance with the applicable policy or assist in identifying alternative accommodations, without obligation.
mediumterm.ch shall not be liable for indirect losses, expenses, or inconvenience resulting from cancellations.
6. Security Deposits
Certain listings may require a security deposit, which will be disclosed prior to booking.
- Security deposits are managed solely by the Host, unless explicitly stated otherwise;
- mediumterm.ch does not act as an escrow agent and does not hold deposit funds by default;
- mediumterm.ch does not verify evidence, arbitrate disputes, or enforce deposit claims.
Any dispute must be raised in writing within 48 hours of check-out.
7. Tenant Responsibilities
During your stay, you agree to:
- Use the property with care, respect, and cleanliness;
- Comply with house rules, building regulations, and applicable laws;
- Refrain from illegal activity, nuisance, subletting, or commercial use;
- Communicate promptly with the Host regarding issues or changes;
- Vacate the property on time unless an extension is formally agreed.
You are financially responsible for any damage, loss, or excessive wear caused during your stay.
8. Check-In, Check-Out & Support
Check-in and check-out procedures vary by property and are communicated by the Host.
mediumterm.ch is not responsible for access issues, lost keys, or delays caused by Host-Tenant communication.

9. Personal Data and Privacy
Personal data is processed in accordance with the Swiss Federal Act on Data Protection (nLPD) and, where applicable, the GDPR.
Your data is used solely for Platform functionality and shared only with relevant Hosts.
Misuse of personal data may result in account suspension and legal action.
10. Account Termination
You may close your account at any time, provided no active or future bookings exist.
mediumterm.ch may suspend or permanently terminate accounts in cases of breach, fraud, circumvention of the Platform, or abusive behavior.
11. Liability Disclaimer and Indemnity
To the maximum extent permitted by law, mediumterm.ch is not liable for:
- Acts or omissions of Hosts or other users;
- Property conditions, safety, legality, or compliance;
- Personal injury, theft, loss, or damages incurred during a stay.
You agree to indemnify and hold harmless Novagen SA from any claims, disputes, or liabilities arising from your use of the Platform.
Total liability of mediumterm.ch, if any, shall not exceed the total service fees paid by you to the Platform in the preceding 12 months.
12. Force Majeure
mediumterm.ch shall not be liable for failure or delay caused by events beyond its reasonable control, including natural disasters, pandemics, strikes, governmental actions, or infrastructure failures.
13. Governing Law and Jurisdiction
These Terms are governed by Swiss law.
Exclusive jurisdiction lies with the courts of Lugano, Suisse.
14. Final Provisions
If any provision is held unenforceable, the remaining provisions remain in effect.
mediumterm.ch may amend these Terms at any time. Continued use implies acceptance.

1. Introduction
These Terms govern your use of the mediumterm.ch Platform as a property owner or authorized host (“you” or “Host”).
The Platform is operated by Novagen SA, Via Cantonale 11, c/o Studio Commercialista Francesco Ippolito, 6900 Lugano, Switzerland, under Swiss law.
mediumterm.ch is a neutral listing and communication platform and does not act as broker, agent, or rental manager.
2. Eligibility
You confirm that you:
- Are at least 18 years old and legally authorized to rent the property;
- Are the legal owner or have written authorization to act on behalf of the owner;
- Comply with all applicable federal, cantonal, and municipal regulations.
3. Property Listings
You are solely responsible for the accuracy, legality, and completeness of your listings, including pricing, availability, photos, and rental conditions. mediumterm.ch may edit, suspend, or remove listings at its discretion.
4. Host Responsibilities
You are solely responsible for:
- Property condition, safety, and habitability;
- Tenant communication and contract execution;
- Check-in, check-out, and dispute handling.
mediumterm.ch is not a party to any rental agreement.
5. Tenant Screening
Optional verification services may be offered.
mediumterm.ch does not guarantee tenant suitability.
6. Fees and Payments
All Platform fees are disclosed in advance.
mediumterm.ch does not collect rent or enforce payments unless explicitly stated.
7. Cancellations
You define your own cancellation policy per listing.
Unjustified cancellations may result in penalties or deactivation.
8. Damage and Deposits
Security deposits are managed by you unless otherwise stated.
All claims must be documented within 48 hours of tenant departure.
9. Liability and Indemnity
mediumterm.ch provides no guarantees regarding bookings, tenants, or income.
You agree to indemnify and hold harmless Novagen SA from any claims arising from your use of the Platform.
Total liability, if any, is limited to fees paid to the Platform in the preceding 12 months.
10. Blue Badge Verification
The “Blue Badge” indicates a one-time physical verification.
It does not constitute a warranty or ongoing monitoring.
11. Insurance
You are solely responsible for appropriate property and liability insurance.
12. Third-Party Services
Third-party services operate independently.
mediumterm.ch assumes no responsibility for their performance.
13. User Conduct
You may not:
- Circumvent the Platform;
- Scrape or reuse Platform data, including for AI training;
- Publish illegal, misleading, or discriminatory content.
14. Termination
Accounts may be suspended or terminated for violations or legal risk.
15. Data Protection
Tenant data must be used exclusively for rental-related purposes.
16. Governing Law and Jurisdiction
Swiss law applies.
Exclusive jurisdiction: Lugano, Suisse.
17. Amendments
mediumterm.ch may update these Terms at any time. Continued use implies acceptance.
